Last week, Eanes ISD and WAQUA and WACC entered a formal agreement to continue the pause in litigation until May 1, 2026. The spirit of the agreement is to allow time for negotiation of new operation agreements for the facilities.
Eanes ISD continues to reiterate to its current partner that it is obligated to continue to maintain and operate the facilities.
Jan. 9, 2026
Earlier this week, Eanes ISD sent its request for the WACC management to convey the title of the building to the District. The agreement between Eanes ISD and WACC states that after 10 years of the "Commencement Date" of the contract (Dec. 12, 2015), ownership and title rights to the building "shall automatically transfer" to Eanes ISD (see Section 5.07 of the Agreement). This agreement also says that WACC shall execute all documents necessary to reflect the ownership and title transfer.

This transfer of title is unrelated to the ongoing litigation. Currently, both parties are working on an extension to the pending litigation to continue ongoing partnership conversations.
Know that the transfer of ownership of the WACC building to Eanes ISD will have no impact on the management and operations of the building, which will continue to be operated by current management. Ongoing access and memberships will not be impacted by this request to transfer ownership of the building.

We have learned that recently “the WACC Team” sent communication to Westlake Athletic Community Center (WACC) patrons with misinformation. Eanes ISD would like to take the opportunity to clarify the ongoing situation.
Timeline History:
- April 7, 2025: Eanes ISD issued notice of termination of its contracts to WACC and WAQUA, LLC.
- April 30, 2025: WACC and WAQUA filed two petitions for “Permanent Injunctions” to stop the termination of the contracts.
- June 27, 2025: Eanes ISD and WACC and WAQUA entered into a “Rule 11 Agreement” to postpone the injunction hearings and postpone termination of the WAQUA contract to Jan. 5, 2026, to allow for possible settlement discussions (Eanes ISD’s original notice of termination for the WACC contract was (and still is) Jan. 5, 2026).
The WACC Team’s recent communication says that on Jan. 5 the WACC will remain open and the management company will continue to operate it for Eanes ISD. This is at the center of the legal dispute. At no point has Eanes ISD said it will “shut down the WACC” or “take the WACC from the community.” However, Eanes ISD does have a legitimate need to use part of the WACC for educational purposes, which requires a different management structure than the one currently in place.
The Rule 11 Agreement remains in effect as both parties explore the possibility of a settlement. All conversations related to these settlement discussions are confidential. Should the discussions fail to result in an agreement, Eanes ISD still plans to establish new management for both the WACC and WAQUA facilities.
Eanes ISD understands WACC and WAQUA membership fees are due soon. Each member needs to make a personal decision about continuing their membership while Eanes ISD seeks to terminate its management contracts.
We urge our community to rely on this page of the Eanes ISD website for any factual information regarding the status of WACC and WAQUA. Unfortunately, this is not the first time the management company circulated incorrect information. The District would be deeply disappointed if community members were misled when making any personal financial decisions.

FAQs Regarding WACC and WAQUA Contract Terminations and Future Use

We understand the community connection to both the Westlake Athletic & Community Center (WACC) and the Westlake Aquatic Center (WAQUA). Not surprisingly, we have received several questions after announcing the termination of the two separate agreements on April 10, which included information, documentation, and photo evidence detailing the District’s position. Since then, the company that manages both WACC and WAQUA has issued or contributed to numerous incorrect statements regarding the District’s action and the future of the facilities.
With termination in process, the District can now begin exploring alternative arrangements for subscribers and users of each facility. We anticipate sharing more details about these plans before the end of the school year. Although no specific options can be confirmed at this time, the following are factual clarifications related to both facilities.
WAQUA – termination to take effect Aug. 1, 2025
The Aug. 1, 2025 termination is not meant to restrict access to the Westlake Aquatics Center (WAQUA) for families or community members. Instead, the District decided it must end the contractual relationship with the management company that has repeatedly failed to maintain the WAQUA in accordance with health and safety standards.
It is premature to suggest the facilities will no longer be available to families, members or community teams and clubs. The District is already exploring a new management arrangement and intends to maintain an ongoing partnership with club swim teams.
The District has determined immediate action is necessary to protect the community’s investment in the pool. Terminating the agreements at this time allows the District to do so contractually, without financial obligations to the management company while restoring the facility to the standards and potential originally envisioned.
WACC – termination to take effect Jan. 5, 2026
The objective of the Jan. 5, 2026 termination is to end a contractual relationship that has constrained Westlake High School's current and future educational use of the WACC. Repurposing the WACC will allow WHS to better utilize the facility for innovative academic purposes. Declining enrollment is not a factor in this decision; rather, expanding learning opportunities for students is beneficial for the entire community.
Terminating the agreement at this time allows the District to do so contractually, without financial obligations to the management company. This step is essential to repurpose the WACC for expanded educational opportunities.
Contrary to recent claims, Westlake High School’s athletic, kinesthetic, performing arts and instructional programs will not be excluded from using the WACC. In fact, the District’s goal is to reimagine the center in a way that expands access to meet the evolving academic needs of WHS students. This includes reclaiming weekday space during school hours - space that was initially intended for the high school but has increasingly become inaccessible. The reimagined use will also prioritize access for Eanes ISD student-athletes and performers.
In the coming months, Eanes ISD anticipates having a more concrete plan for the WACC and will continue to update the community accordingly. The contract requires a 270 day notice for termination to allow for any private persons potentially impacted to have time to make necessary accommodations.
